Massachusetts Requires Carbon Monoxide Detectors

Massachusetts enacted legislation in November 2005 that requires carbon monoxide detectors in residential dwellings. It was the ninth state in the U.S. to pass such a law.

The law goes into effect on March 31, 2006 for most residential buildings. Devices will be required in any residence that "(1) contains fossil-fuel burning equipment including, but not limited to, a furnace, boiler, water heater, fireplace or any other apparatus, appliance or device; or (2) incorporates enclosed parking within its structure."

In most residences, compliance with the law will simply require installation of a battery-powered or plug-in detector.

Enforcement of the carbon monoxide detector law, like the state's smoke detector law, will be carried out by local fire departments during home inspections prior to the sale or transfer of property.
